LAZ member accuses president of acting without mandate
A member of the Law Association of Zambia says the association’s president acted improperly by engaging with the OASIS forum and making public statements on Bill 7 without first securing direction from the membership.
Clement Andeleki said President Lungisani Zulu had no mandate to represent the association in that way and has called the conduct unethical and professionally improper.
Dr. Andeleki who is also UPND Katombola Member of Parliament has described the Law Association as a body of distinguished legal practitioners, including judges and lawyers, and said the president’s pronouncements urging people to take to the streets in pursuit of regime change were unacceptable.
He said the correct procedure was for the president to seek a formal mandate from the general membership before taking such positions or pursuing costly litigation.
Dr. Andeleki has noted that doing otherwise risks condemnation in court and endangers the association’s financial resources, which come from members’ substantial contributions.
He said the president did the right thing by convening the general membership on 16 December to seek their position on the matter, but insisted this should have been done long before taking the issue to court.
Dr. Andeleki has argued that the LAZ president should first have engaged members to determine whether the association should support or oppose Constitutional Amendment Bill No. 7, stressing that any decision binding the membership must be grounded in an explicit mandate.
He has warned that a loss in the Constitutional Court would result in the association being condemned to pay costs, further jeopardizing members’ resources.
He has emphasized that members contribute significant sums to practice law in Zambia, unlike some other professions that pay minimal fees.
While distancing himself personally from Mr. Zulu, Dr. Andeleki said the association itself must be protected.
He has condemned the president’s earlier statements as having serious consequences, and appealed for strict adherence to membership mandates in future.
Dr. Andeleki has expressed confidence that the general members, meeting on the day, would decide on the proper course of action.
